Law Enforcement & Government Requests Guidelines

1. About these Guidelines

These Guidelines explain how law enforcement, judicial, regulatory and other competent public authorities may submit requests to SPACELAMA Korlátolt Felelősségű Társaság ("SpaceLama") concerning SpaceLama services or customers.

SpaceLama responds to valid requests from competent authorities in accordance with applicable law while protecting the privacy, confidentiality and rights of its customers and other affected persons.

These Guidelines do not limit or modify any rights or obligations arising under applicable law.

2. Contact for Public Authorities

Requests from law enforcement, judicial, regulatory and other competent public authorities should be submitted electronically to:

For the purposes of Article 11 of Regulation (EU) 2022/2065 (Digital Services Act), SpaceLama has designated the following single electronic point of contact for communications with Member State authorities, the European Commission and the European Board for Digital Services:

Where Regulation (EU) 2021/784 on addressing the dissemination of terrorist content online applies, removal orders should be submitted to SpaceLama's designated contact point:

The same electronic contact may be designated for more than one of these purposes where it satisfies the applicable legal and operational requirements.

Reports concerning phishing, malware, spam or other abuse that do not constitute official governmental requests should be submitted in accordance with SpaceLama's Abuse Handling Policy.

3. Information for General Requests

For requests that are not submitted using a form or procedure prescribed by applicable law, authorities should provide, as applicable:

  • the name of the requesting authority;
  • the name, official position and official contact details of the requesting officer or representative;
  • the legal basis and nature of the request;
  • an official case or reference number, where available;
  • clear identification of the relevant domain name, account, IP address, URL or other service;
  • the specific information or action requested;
  • the relevant date or time period;
  • any applicable deadline;
  • any applicable confidentiality or non-disclosure requirement; and
  • the relevant order, warrant, decision or other legal instrument, where applicable.

Requests should be sufficiently specific to enable SpaceLama to identify the relevant service, information or action.

Where applicable law prescribes a specific form, content, transmission method or procedure, those requirements prevail over this Section.

4. Verification and Legal Process

SpaceLama assesses governmental requests before disclosing non-public information or taking action affecting a customer or service.

Depending on the nature of the request, SpaceLama may verify:

  • the identity and authority of the requester;
  • authenticity of the request;
  • applicable legal basis and jurisdiction;
  • whether SpaceLama is the appropriate recipient;
  • scope of the information or action requested; and
  • applicable procedural and data-protection requirements.

Submission of a request does not by itself entitle the requesting authority to access customer information.

Where permitted by applicable law, SpaceLama may request clarification, challenge or decline a request that is unauthenticated, insufficiently specific, outside the applicable legal authority or otherwise does not satisfy applicable legal requirements.

5. Requests for Information and Preservation

Subject to applicable law and the services concerned, SpaceLama may hold certain information relating to its customers, accounts, domain registration services and hosting services.

SpaceLama will disclose only information that:

  • is available to SpaceLama;
  • falls within the lawful scope of the request; and
  • may lawfully be disclosed to the requesting authority.

SpaceLama cannot guarantee that particular information is available in relation to a specific customer or service.

SpaceLama does not create information that does not exist and does not retain information solely in anticipation of a possible future authority request, except where retention or preservation is required by applicable law or valid legal process.

Requests concerning non-public domain registration data are also subject to applicable registration-data disclosure requirements.

Preservation

A preservation request should clearly identify the relevant customer, account, domain or service, the information to be preserved, the relevant time period and the applicable legal basis.

SpaceLama will preserve available information where required by applicable law and within the scope of a valid preservation requirement.

A preservation request does not by itself authorise disclosure of the preserved information. A separate lawful basis for production or disclosure may be required.

6. Orders under the Digital Services Act

SpaceLama processes orders to act against illegal content and orders to provide information under Articles 9 and 10 of Regulation (EU) 2022/2065 (Digital Services Act) in accordance with the requirements of the DSA and applicable national procedural law.

Such orders should be transmitted to SpaceLama's designated electronic point of contact and satisfy the requirements applicable under the relevant DSA provision.

For an Article 10 order, the information requested must be limited to information already collected for the purpose of providing the service and within SpaceLama's control, as required by the DSA.

SpaceLama will provide information concerning the effect given to an Article 9 or Article 10 order and other notifications where required by the DSA.

7. Terrorist Content Removal Orders

Where Regulation (EU) 2021/784 applies to SpaceLama's hosting services, removal orders under that Regulation should be submitted electronically to the designated contact point specified in Section 2.

SpaceLama treats such orders as urgent and processes them in accordance with the requirements and statutory deadlines established by Regulation (EU) 2021/784.

Where a valid removal order applies, SpaceLama will remove the identified terrorist content or disable access to it as soon as possible and in any event within the period required by the Regulation.

Authorities should use the applicable statutory form and provide the information required by Regulation (EU) 2021/784.

8. European Production and Preservation Orders

European Production Order Certificates (EPOCs) and European Preservation Order Certificates (EPOC-PRs) concerning services for which SpaceLama falls within the scope of Regulation (EU) 2023/1543 must be addressed and transmitted in accordance with that Regulation, including its rules concerning the designated establishment or legal representative.

SpaceLama processes valid EPOCs and EPOC-PRs within the applicable statutory framework and deadlines.

A European Preservation Order requires preservation of the specified data but does not by itself authorise disclosure of those data.

9. Requests Concerning Domain Names

SpaceLama currently provides domain registration services as a reseller and does not exercise all technical powers of a sponsoring registrar or registry.

Certain actions concerning a domain name may therefore require action by the relevant sponsoring registrar, registry or another provider exercising the necessary technical control. Depending on the circumstances, these may include:

  • placing a domain on clientHold or another registrar or registry status;
  • applying a registrar or registry lock;
  • suspension or cancellation of a domain registration; or
  • other changes affecting domain resolution or registration status.

Where SpaceLama receives a valid request requiring an action that it cannot technically perform, SpaceLama will, where appropriate, refer or escalate the matter to the relevant sponsoring registrar or other competent provider.

Authorities should clearly identify the domain concerned and the information or action sought.

10. Requests Concerning Hosted Content

Where a valid legal request or order concerns content hosted through SpaceLama's shared hosting services, SpaceLama will take action within its technical control as required by applicable law.

Requests should identify the relevant content as precisely as possible, including the URL, domain or other electronic location where appropriate.

SpaceLama seeks to limit any restriction to the information or service concerned where technically possible and legally appropriate.

Specific requirements applicable to orders under the Digital Services Act or Regulation (EU) 2021/784 take precedence.

11. Emergency Requests

Requests concerning an imminent threat to life or physical safety should be clearly identified as EMERGENCY and submitted to:

The request should provide sufficient information to enable SpaceLama to assess the nature and urgency of the situation, including, as applicable:

  • the identity and official contact details of the requesting authority;
  • the nature of the emergency;
  • the relevant person, account, domain, IP address or service;
  • the information or action requested; and
  • the legal basis for the request.

Marking a request as an emergency does not by itself create authority for disclosure. SpaceLama assesses emergency requests on an expedited basis in accordance with applicable law.

12. Requests from Authorities Outside the EU/EEA

Requests from authorities outside the European Union and European Economic Area are assessed in accordance with applicable EU and Hungarian law.

Where a request involves the disclosure or transfer of personal data subject to the GDPR, SpaceLama will take into account Article 48 and Chapter V GDPR, including, where applicable, relevant international agreements, mutual legal assistance mechanisms or other lawful mechanisms for international cooperation and data transfer.

A request or decision of a third-country authority does not by itself require SpaceLama to disclose personal data or confidential customer information where such disclosure would not be lawful under applicable EU or Hungarian law.

13. Customer Information and Data Protection

SpaceLama processes personal data contained in, or disclosed in response to, governmental requests in accordance with applicable data-protection law.

SpaceLama seeks to limit disclosures to information that is necessary and within the lawful scope of the relevant request and uses appropriate measures to protect information during transmission.

Notification of affected customers is handled in accordance with applicable law and the requirements of the relevant legal process. Where notification is prohibited or required to be delayed by law or a valid order, SpaceLama will comply with those restrictions.
