Abuse Reports Handling Policy

1. Purpose and Scope

This Abuse Handling Policy explains how SPACELAMA Korlátolt Felelősségű Társaság ("SpaceLama", "we", "us"), a limited liability company incorporated in Hungary under company with its registered office at 55-57 Központi út, 1211 Budapest, Hungary, receives, assesses and handles reports concerning suspected abuse, illegal activity or illegal content involving services provided by SpaceLama.

This Policy applies to:

  • domain names registered or managed through SpaceLama as a domain name reseller; and
  • content and activities using shared hosting services provided by SpaceLama.

Different technical and legal measures are available depending on the service concerned. In particular, SpaceLama does not operate a domain name registry and is not the sponsoring registrar of domain names registered through its service. Domain registrations are procured through third-party sponsoring registrars. SpaceLama therefore cannot itself perform certain registry- or registrar-level actions against a domain name. Where such action may be appropriate, SpaceLama may refer or escalate the matter to the relevant sponsoring registrar, registry operator or other competent service provider.

For content stored using SpaceLama's shared hosting services, SpaceLama may take measures directly in accordance with applicable law, our Terms of Service, Hosting Agreement and this Policy.

2. Reporting Abuse

Suspected abuse involving a domain name registered through SpaceLama or content hosted using SpaceLama's shared hosting services may be reported to: abuse@spacelama.com

Reports should contain sufficient information to allow us to identify the affected service and understand and assess the reported activity.

Where applicable, please provide:

  • the affected domain name;
  • the specific URL(s), IP address or other location of the reported activity or content;
  • a clear description of the alleged abuse or illegal activity;
  • the type of abuse being reported, where known;
  • the date and time when the activity was observed;
  • relevant supporting evidence, such as message headers, logs or other technical information;
  • where the report concerns allegedly illegal content, an explanation of why the reporter considers the identified content to be illegal and, where reasonably possible, the relevant legal basis;
  • any other information reasonably necessary to verify the report.

Reports should identify the specific domain, content or activity concerned. Broad allegations without sufficient information to locate or assess the reported matter may not enable SpaceLama to take action.

A reporter should not submit passwords, payment-card information, identification documents or other personal data that are not necessary for assessing the report.

3. DNS Abuse

For the purposes of this Policy, DNS Abuse includes the following activities where a domain name is used to carry them out:

  • malware — software installed or used without appropriate authorisation and intended to compromise devices, systems or data;
  • botnets — networks of compromised devices coordinated for malicious activity;
  • phishing — deceptive practices intended to induce users to disclose credentials, personal data or other sensitive information;
  • pharming — techniques that redirect users to fraudulent destinations through manipulation of DNS or related technical mechanisms; and
  • spam, where unsolicited electronic communications are used as a delivery mechanism for malware, botnets, phishing or pharming.

Other unlawful, fraudulent or abusive conduct involving a domain may also be reported under this Policy even where it does not fall within the definition of DNS Abuse.

4. Other Abuse and Illegal Activity

Reports may also concern other suspected unlawful or abusive use of SpaceLama's services, including, where applicable:

  • fraud, impersonation or scams;
  • unauthorised access, hacking or attempts to compromise systems or accounts;
  • denial-of-service attacks or infrastructure used to facilitate such attacks;
  • illegal distribution or exploitation of personal or confidential information;
  • child sexual abuse material ("CSAM");
  • content or activity prohibited by applicable law;
  • activity infringing SpaceLama's Terms of Service, Hosting Agreement or other applicable service terms; or
  • other conduct that materially threatens the security, stability or integrity of SpaceLama's services, infrastructure or users.

The fact that an activity has been reported does not by itself establish that abuse or illegal activity has occurred. SpaceLama assesses reports on the basis of the information reasonably available to it and the nature of the service concerned.

5. Content Hosted by SpaceLama

Where a report concerns information stored using SpaceLama's shared hosting services, the reporter should identify the specific content concerned, preferably by providing the exact URL or other information allowing SpaceLama to locate it.

A notice concerning allegedly illegal content should contain sufficient information to enable SpaceLama to identify the specific information concerned and assess the alleged illegality. In particular, the notice should contain:

  • a sufficiently substantiated explanation of why the reporter considers the information to be illegal;
  • a clear indication of the exact electronic location of the information, such as the relevant URL or URLs, and, where necessary, additional information enabling SpaceLama to identify the illegal content;
  • the reporter's name and email address, except in relation to information considered to involve an offence referred to in Articles 3 to 7 of Directive 2011/93/EU; and
  • a statement confirming the reporter's bona fide belief that the information and allegations contained in the notice are accurate and complete.

Receipt of a notice does not by itself establish that the reported information is illegal. However, where a notice contains sufficient information to enable SpaceLama, acting as a diligent provider of hosting services, to identify the illegality of the relevant information or activity without a detailed legal examination, the notice may give rise to actual knowledge or awareness of the illegal information or activity.

Where the reporter has provided electronic contact information, SpaceLama will send confirmation of receipt of the notice without undue delay.

Where SpaceLama obtains knowledge through a notice submitted under Article 16 of the Digital Services Act that illegal content is available through its hosting service, SpaceLama will remove the illegal content or disable access to it without undue delay in accordance with applicable law.

SpaceLama assesses such notices in a timely, diligent, objective and non-arbitrary manner. The submission of a notice does not guarantee removal, suspension or any other particular outcome.

Where the reporter has provided electronic contact information, SpaceLama will, without undue delay, notify the reporter of its decision concerning the reported information and provide information on the available possibilities for redress.

6. Domain Names Registered Through SpaceLama

SpaceLama provides domain name registration services as a reseller. Depending on the domain concerned, the registration is procured through a third-party sponsoring registrar.

SpaceLama does not operate the relevant TLD registry and does not itself exercise registrar- or registry-level technical control over a registered domain.

When SpaceLama receives a report concerning a domain registered through its service, it may, as appropriate:

  • verify whether the domain is registered or managed through SpaceLama;
  • review the information and evidence submitted;
  • request additional information from the reporter;
  • review information reasonably available to SpaceLama concerning the domain or customer account;
  • contact the registrant and request information, explanation or remediation where appropriate;
  • refer or escalate the report and relevant evidence to the sponsoring registrar, registry operator or other service provider capable of taking the necessary technical action;
  • request that the sponsoring registrar consider appropriate mitigation measures;
  • restrict services or account functionality that are under SpaceLama's own control where permitted by the applicable agreement and law; or
  • cooperate with a competent authority where required or permitted by applicable law.

Any registrar- or registry-level action, including placing a domain on hold, suspending or cancelling the registration, applying a registry or registrar lock, changing the registration status or otherwise disabling resolution of the domain, is subject to the powers, procedures and decision of the relevant sponsoring registrar or registry operator where SpaceLama does not itself have the technical or legal ability to implement that measure.

SpaceLama does not guarantee that a sponsoring registrar or registry operator will take a particular action following an escalation.

7. Investigation and Assessment

The measures taken in response to a report will depend on the circumstances of the individual case.

SpaceLama may consider, among other relevant factors:

  • the nature and seriousness of the reported activity;
  • the quality, reliability and completeness of the evidence;
  • whether the reported activity can be independently verified;
  • whether the affected service is provided or controlled by SpaceLama;
  • whether the domain or account appears to have been intentionally used for abuse or may itself have been compromised;
  • the extent and immediacy of actual or potential harm;
  • whether remedial action can stop or materially reduce the reported harm;
  • the potential effect of a proposed measure on lawful content, communications, users or services;
  • applicable law;
  • applicable contractual terms; and
  • applicable requirements or instructions of the sponsoring registrar or registry operator.

SpaceLama may request additional information where the report does not contain enough information to make a reasonably informed assessment.

No particular action is automatic merely because a report has been submitted.

8. Mitigation Measures

Where SpaceLama is required by applicable law to remove illegal content or disable access to it, SpaceLama will take the required measure without undue delay.

In other cases, where, following assessment of an Abuse Report, SpaceLama determines that action is warranted, the measures taken will depend on the nature and seriousness of the reported activity, the Service concerned, the evidence available, SpaceLama's technical capabilities and contractual rights, and applicable law.

SpaceLama may, as appropriate:

  • request further information or evidence from the Customer or reporter;
  • require the Customer to cease or remedy the abusive or unlawful activity;
  • require the Customer to secure a compromised account, website or other resource;
  • temporarily restrict or suspend Hosting Services or access to a hosting account;
  • temporarily or permanently remove a website from SpaceLama's servers where permitted under the Hosting Agreement;
  • suspend or terminate Hosting Services where the Services are used for abusive or unlawful purposes, where the Customer violates the Hosting Agreement or applicable Acceptable Use Policy, or where the relevant activity compromises the security, stability or integrity of SpaceLama's Services, infrastructure or other customers;
  • take technical or security measures available to SpaceLama in connection with an investigation, including temporary suspension, access restriction, log review or traffic analysis;
  • restrict, suspend or terminate a SpaceLama account or access to Services where permitted under the applicable contractual terms and applicable law;
  • refer or escalate a domain-related matter to the relevant sponsoring registrar, registry operator or other service provider where action outside SpaceLama's technical control may be required;
  • request that the relevant sponsoring registrar or other competent provider consider appropriate mitigation measures; and
  • report or refer suspected illegal activity to a competent authority where permitted or required by applicable law.

SpaceLama will determine the appropriate measure having regard to the circumstances of the individual case. Where reasonably practicable and effective, SpaceLama will seek to avoid measures that unnecessarily affect lawful services or information unrelated to the identified abuse.

Where immediate action is reasonably necessary to protect the security or stability of the Services or network, prevent or mitigate ongoing phishing, malware, hacking, denial-of-service activity or other serious abuse, protect other customers or users, or comply with a binding legal requirement, SpaceLama may take available protective measures without prior notice to the Customer, subject to applicable law.

For domain names registered through SpaceLama, any measure requiring registrar- or registry-level technical control is subject to Section 6 of this Policy.

9. Action Concerning Hosted Services and Information

Where an Abuse Report concerns information stored using SpaceLama's shared hosting services, SpaceLama will assess the report in accordance with this Policy and applicable law, including the requirements governing notices of allegedly illegal content under the Digital Services Act.

The submission of a report does not by itself establish that the reported information is illegal and does not automatically result in removal of a website, suspension of an account or termination of Hosting Services.

Where SpaceLama obtains knowledge through a notice submitted under Article 16 of the Digital Services Act that illegal content is available through its hosting service, SpaceLama will remove the illegal content or disable access to it without undue delay in accordance with applicable law.

Where the reported information or activity instead constitutes a violation of SpaceLama's contractual terms, SpaceLama may take the measures available under the applicable Terms of Service, Hosting Agreement or other applicable service terms.

Under the Hosting Agreement and Terms of Service, SpaceLama may, depending on the circumstances, restrict or suspend access to Hosting Services, temporarily or permanently remove a website from its servers, suspend or terminate a hosting account or Hosting Services, or take other technical or security measures expressly available to SpaceLama under those terms.

In determining the appropriate measure, SpaceLama may take into account, as relevant:

  • the nature, seriousness and duration of the reported activity;
  • whether the information or activity is unlawful or violates the applicable contractual terms;
  • the reliability and sufficiency of the available evidence;
  • whether the Customer appears to be responsible for the activity or whether the website or account has been compromised;
  • the actual or potential harm to users, third parties, SpaceLama's infrastructure or other customers;
  • whether the Customer can effectively remedy the issue;
  • the urgency of the situation; and
  • the potential impact of the proposed measure on lawful websites, information or services.

Where SpaceLama imposes a restriction covered by Article 17 of the Digital Services Act on the ground that information provided by the Customer is illegal or incompatible with SpaceLama's contractual terms, SpaceLama will provide the affected Customer with a clear and specific statement of reasons in accordance with Article 17 of the Digital Services Act, unless an applicable exception applies.

Where a restriction is imposed pursuant to a binding order or where notification is restricted or prohibited by applicable law, the applicable legal requirements governing notification shall apply.

10. Compromised Domains and Accounts

A domain name or hosting account involved in abuse may itself have been compromised without the customer's knowledge.

Where the available information reasonably indicates compromise rather than intentional abuse, SpaceLama may, where appropriate, give the customer an opportunity to secure the affected account, remove malicious content, reset credentials, patch vulnerable software or take other corrective measures.

This does not prevent SpaceLama from taking or requesting urgent protective measures where necessary to stop or materially disrupt ongoing abuse.

11. Reports Concerning Content Not Hosted by SpaceLama

Registration of a domain name through SpaceLama does not mean that the website or other content accessible through that domain is hosted or controlled by SpaceLama.

Where a complaint concerns particular website content that is hosted by another provider and does not otherwise present a matter requiring action at the domain-registration level, the hosting provider or other service provider controlling the content may be better placed to assess and act upon the complaint.

SpaceLama may therefore direct the reporter to the relevant hosting provider or other service provider, or forward or escalate the report where appropriate.

SpaceLama will not represent that it can remove particular third-party-hosted content where it does not have the technical ability or legal authority to do so.

12. Intellectual Property and Domain Name Disputes

A complaint concerning ownership of, or rights in, a domain name is not automatically treated as DNS Abuse.

Trademark, cybersquatting and other domain-name disputes may be subject to the Uniform Domain Name Dispute Resolution Policy ("UDRP"), Uniform Rapid Suspension System ("URS"), an applicable ccTLD dispute-resolution procedure, court proceedings or another procedure established by the relevant registry or registrar.

SpaceLama does not adjudicate competing claims to intellectual property rights or ownership of domain names where those claims are required to be determined through an applicable dispute-resolution or judicial procedure.

Complaints concerning allegedly infringing content hosted using SpaceLama's hosting services may, however, be submitted under this Policy and will be assessed according to the applicable law and circumstances.

13. CSAM and Other Serious Illegal Content

Reports concerning suspected CSAM or other material whose possession or redistribution may itself be unlawful should identify the location of the material without attaching, copying or redistributing the material to SpaceLama unless expressly instructed by a competent authority.

Where information available to SpaceLama gives rise to a suspicion that a criminal offence involving a threat to the life or safety of one or more persons has taken place, is taking place or is likely to take place, SpaceLama will promptly notify the competent law-enforcement or judicial authorities in accordance with Article 18 of the Digital Services Act.

Other reports concerning serious illegal content may be referred to competent authorities or recognised reporting bodies where appropriate or required by applicable law.

SpaceLama may take urgent measures within its control, and may urgently escalate domain-related matters to the relevant sponsoring registrar or other competent provider, where reasonably necessary to prevent continuing serious harm.

14. Law Enforcement and Government Authorities

SpaceLama cooperates with valid and legally binding requests, orders and other lawful demands issued by courts, law-enforcement bodies, regulatory authorities and other competent public authorities.

A request should clearly identify the requesting authority, the relevant legal basis, the information or action requested, the affected domain, account or service, and any applicable deadline or urgency. SpaceLama may verify the authenticity, legal basis, jurisdiction and scope of a request before acting on it.

Nothing in this Policy requires SpaceLama to take an action that would contravene applicable law.

Further requirements applicable to law-enforcement and government requests are handled under SpaceLama's internal procedures.

15. Emergency Situations

Where a report indicates an imminent risk to life or physical safety, active exploitation of users, ongoing serious cyber abuse or another situation requiring urgent intervention, the reporter should clearly identify the report as URGENT and explain the nature and immediacy of the risk.

Marking a report as urgent does not automatically result in suspension or other action. SpaceLama will assess the circumstances and take or request measures reasonably available to it.

16. Information About Reporters and Confidentiality

SpaceLama processes personal data contained in abuse reports in accordance with applicable data protection law and its Privacy Notice.

Submitting an abuse report does not automatically authorise SpaceLama to disclose the reporter's identity or contact information to the affected customer.

SpaceLama may disclose information contained in a report to the affected customer, sponsoring registrar, registry operator, hosting or infrastructure provider, competent authority, professional adviser or another relevant recipient where such disclosure is reasonably necessary and lawful for the investigation, mitigation or resolution of the reported matter.

Where possible and appropriate, SpaceLama may limit the personal data disclosed to what is necessary for that purpose.

Reporters should therefore avoid including unnecessary personal, confidential or sensitive information in an abuse report.

17. Notifications

Where a reporter has submitted a notice concerning allegedly illegal hosted content and provided electronic contact information, SpaceLama will provide the notifications described in Section 5 of this Policy.

Where SpaceLama imposes a restriction covered by Article 17 of the Digital Services Act on the ground that information provided by a Customer is illegal or incompatible with SpaceLama's contractual terms, SpaceLama will provide the affected Customer with the statement of reasons required under Section 9 of this Policy.

Different notification requirements may apply where action is taken pursuant to a binding order or where notification is restricted or prohibited by applicable law.

Where domain-level action is taken by a sponsoring registrar or registry operator, the notification procedure may be governed by that party's applicable policies and procedures.

18. False, Abusive or Misleading Reports

Reports should be made in good faith.

SpaceLama may decline to act on reports that are manifestly unfounded, materially incomplete, fraudulent, abusive or submitted for purposes unrelated to legitimate abuse reporting.

Knowingly submitting false information, impersonating another person or authority, manipulating evidence, or repeatedly using the abuse process to harass customers or interfere improperly with lawful services may itself constitute a violation of SpaceLama's applicable terms or applicable law.

Nothing in this section prevents a reporter from submitting a good-faith report that SpaceLama ultimately determines does not require action.

19. Relationship with Other Policies and Procedures

This Policy should be read together with SpaceLama's Terms of Service, Domain Name Registration Agreement, Hosting Agreement and Privacy Notice.

Where a domain name is registered through a third-party sponsoring registrar or registry, the registration may also be subject to that registrar's or registry's applicable policies, procedures and contractual requirements.

Requests seeking disclosure of non-public domain registration data are not abuse reports merely because they relate to suspected abuse. Such requests are handled under SpaceLama's applicable registration-data disclosure procedure.

Domain-name disputes governed by UDRP, URS or another mandatory dispute-resolution procedure should be pursued through the applicable procedure.
